Why did he only get probation?

Someone please explain this.

19-year-old on probation for an armed robbery charge faces more charges in connection with a home invasion in Raleigh on June 16, according to arrest warrants.

Arrest warrants state that Smith broke into a house at 2404 Evers Drive and held a woman and four men at gunpoint.

(Suspect) was on probation for a December conviction for conspiracy to commit armed robbery, according to state Department of Correction records. He also has 2008 convictions for two counts each of assault with a deadly weapon and communicating threats and one count each of going armed to the terror of the public and possessing stolen goods.

Armed robbery suspect is 19 years old, has a bunch of misdemeanor convictions from 2008, and then get involved in a conspiracy to commit armed robbery. And then gets 3 years probation instead of a well deserved visit to the iron bar motel.

So guys (and gal) who got their home invaded on June 16, you can thank the judge for that one. This jerk could have been in jail, but he got probation instead. And then he got a gun and came to your house. Fat lot of good his probation did the rest of us.
